Welcome to Yellow Chair Upholstery ("Company," "we," "our," or "us"). We are delighted to provide our upholstery services to you. By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our services. If you do not agree with these Terms, please do not use our services.
1. Upholstery Services
1.1. Description: We offer upholstery services, which include but are not limited to furniture reupholstery, custom upholstery, and upholstery repair.
1.2. Pricing: Our pricing is provided on a case-by-case basis, depending on the scope of the project. You will receive a quote before the commencement of any work.
1.3. Payment: Payment for our services is due as outlined in your project agreement. We accept various payment methods, including cash, checks, and e-transfers.
1.4. Cancellations and Refunds: Cancellation and refund policies are outlined in the project agreement. Deposits are non-refundable, and cancellation fees may apply if material has been ordered.
2. Scheduling and Turnaround Times
2.1. Appointment Scheduling: We will work with you to schedule appointments for fabric consultations, freight, and project completion. Timelines will be discussed during the consultation phase.
2.2. Delays: While we strive to meet agreed-upon project timelines, unforeseen circumstances may cause delays. We will keep you informed of any delays and work diligently to complete your project.
3. Satisfaction Guarantee
3.1. Satisfaction Guarantee: We aim to ensure your satisfaction with our services. We ask that your review all pieces before they leave our shop. If you are not satisfied with our work we will work to address your concerns. Once items leave our property work is considered final and closed, all changes at that time are a new SOW.
4. Customer Responsibilities
4.1. Accurate Information: You are responsible for providing accurate and complete information about your upholstery project, including furniture measurements, design preferences, and any specific requirements.
4.2. Access: If required, you are responsible for providing access to your premises for pickup and delivery.

6.1. Ownership: All intellectual property rights related to our services, including designs and custom upholstery work, remain with the Company.
7. Liability and Dispute Resolution
7.1. Limitation of Liability: To the extent permitted by law, we shall not be liable for any indirect, consequential, or punitive damages arising from the use of our services.
7.2. Dispute Resolution: Any disputes arising from these Terms shall be resolved through arbitration in accordance with the rules of the government of Ontario.
8.1. Termination: We reserve the right to terminate your access to our services if you violate these Terms or engage in any unlawful or inappropriate conduct. This includes, but is not limited to; hate speech, harassment, or physical violence.

9.1. Modification: We may update these Terms from time to time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms regularly.
